Hidro — TERMS OF SERVICE

These Terms govern your access to and use of the Hidro mobile application, websites, APIs, and related services (collectively, the “Service”).

• By creating an account, accessing, or using the Service, you accept these Terms and our Privacy Policy.
• If you use the Service on behalf of an organization, you represent that you have authority to bind that entity and that “you” refers to the entity.
• Additional terms may apply to specific features; where they conflict, those additional terms control to the extent of the conflict.

We may modify these Terms from time to time.

• Material changes will be notified via in-app notice, email, or by updating the “Updated” date above.
• Changes take effect on the stated date; continued use after that date constitutes acceptance.
• If you do not agree with the changes, you must stop using the Service and may request account deletion.

• Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, unless otherwise agreed in writing.
• You must be the age of majority in your jurisdiction or have valid parental/guardian consent.
• We may change, suspend, or discontinue any part of the Service without liability.

• You are responsible for maintaining the confidentiality of your credentials and all activities under your account.
• Provide accurate, current, and complete information and keep it updated.
• Notify us immediately of any unauthorized use or security breach.
• We may reclaim usernames or suspend accounts that violate these Terms or legal requirements.

You retain ownership of content you submit, post, upload, or otherwise make available on or through the Service (“UGC”).

• License to Hidro: You grant us a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, store, use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display your UGC solely for operating, developing, and improving the Service, promoting the Service, and as otherwise permitted by your settings.
• Representations: You represent that you have all rights to grant this license and that your UGC does not infringe third-party rights or violate law.
• Publicity & Visibility: Depending on your settings, your UGC may be public, visible to friends, or private. You are responsible for the audience you choose.
• Feedback: If you submit feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction.

• Do not engage in harassment, hate speech, threats, or illegal activities.
• Do not upload content that is unlawful, infringing, defamatory, obscene, exploitative, or otherwise objectionable.
• Do not attempt to access accounts or data without authorization, interfere with the Service, or reverse engineer, scrape, or use automated means except as allowed by our policies.
• Respect intellectual property, privacy, and applicable local regulations when sharing locations or experiences.

• The Service, including software, design, trademarks, and content (excluding UGC), is owned by Hidro or its licensors and protected by law.
• Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Service.
• Brand assets must be used only with our prior written permission and brand guidelines.

• Paid features may be offered via one-time purchases or subscriptions through app stores or our website.
• Prices and taxes may vary by region. Unless stated otherwise, fees are non-refundable to the maximum extent permitted by law.
• Subscriptions renew automatically unless canceled before the renewal date in your app-store settings.
• We may offer trials or promos; misuse may lead to revocation.

• We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or for operational/security reasons.
• Upon termination, your right to use the Service ends, but certain provisions (e.g., IP, disclaimers, liability, law) survive.
• We may retain and/or delete content per our policies and applicable law.

To the fullest extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE.”

• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content will be accurate or reliable.

• To the maximum extent permitted by law, Hidro and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses.
• Our aggregate liability for all claims relating to the Service shall not exceed the greater of (a) the amounts you paid to us in the 12 months preceding the claim, or (b) USD $50.
• Some jurisdictions do not allow certain limitations; in such cases, the above limitations apply to the fullest extent permitted.

• The Service may integrate with third-party services (maps, payments, logins). We are not responsible for third-party content, policies, or practices.
• Your use of third-party services is governed by their terms and privacy policies.
• Links do not imply endorsement.

• We process personal data as described in our Privacy Policy, which forms part of these Terms.
• Some features require location, camera, photos, or notifications permissions. You can manage permissions in system settings, but certain features may not function without them.
• We implement safeguards to protect data, but no method of transmission or storage is 100% secure.

• These Terms are governed by the laws of the jurisdiction where Hidro is established, without regard to conflict-of-law principles.
• Disputes shall be resolved through good-faith negotiations; if unresolved, they may be submitted to competent courts or arbitration as required by applicable law.
• Mandatory consumer protections in your country of residence remain unaffected.
